Terms of Service

1. Agreement to Terms

By accessing or using Bulgaria Unlocked (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Bultrips Ltd, a licensed tour operator registered in Bulgaria.

Bulgaria Unlocked provides curated audio guides, AR experiences, and GPS-triggered narration for historical sites across Bulgaria. The Service includes:

• Region-based audio content written and narrated by historians
• GPS-aware narration that triggers at specific locations
• Augmented Reality (AR) reconstructions at select sites
• Interactive maps and historical timelines
• User progress tracking and digital passport features

4. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 16 years of age to create an account

You are responsible for all activity that occurs under your account.

5. Purchases and Payments

Certain regions and content within the Service require payment. By making a purchase:

• You agree to pay the fees displayed at the time of purchase
• All payments are processed securely through Stripe
• Purchases are non-refundable except as required by Bulgarian/EU law
• Access to purchased content is perpetual unless otherwise stated
• Prices are displayed in EUR and may include VAT

Right of Withdrawal (EU Consumers): Under EU Directive 2011/83/EU, you have a 14-day right of withdrawal. However, by purchasing and immediately accessing digital content, you acknowledge that you waive this right once download/streaming begins.

6. License to Use

Subject to these Terms and payment of applicable fees, Bultrips Ltd grants you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for personal, non-commercial purposes
• Download and listen to audio content for personal use
• Use AR features at historical sites

You may not:

• Copy, modify, or distribute Service content
• Use the Service for commercial purposes without written consent
• Reverse engineer or attempt to extract source code
• Share your account credentials with others

7. User Conduct

You agree not to:

• Use the Service in any way that violates Bulgarian or EU law
• Upload or transmit harmful, offensive, or infringing content
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service
• Use the Service at historical sites in a manner that violates site rules or endangers safety

8. Intellectual Property

All content, features, and functionality of the Service are owned by Bultrips Ltd and are protected by Bulgarian, EU, and international copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you rights to use any Bultrips Ltd trademarks, logos, or branding.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy or completeness of historical content
• Uninterrupted or error-free operation
• GPS functionality at all locations
• Compatibility with all devices

We do not warrant that the Service will meet your expectations or that historical information will be error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY BULGARIAN AND EU LAW:

• BULTRIPS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR ISSUES ARISING FROM YOUR USE OF HISTORICAL SITES (e.g., injuries, closures, access restrictions)

11. Safety Disclaimer

When using the Service at historical sites:

• Follow all posted rules and regulations at each location
• Be aware of your surroundings, especially when walking
• Do not use headphones in situations where awareness is required for safety
• Bultrips Ltd is not responsible for injuries, accidents, or incidents at historical sites

12. Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your license to use the Service ends immediately. You may still access previously purchased content unless the termination was for cause.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Sofia, Bulgaria, except for consumers who may benefit from mandatory provisions of their local jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the Service or by email. Continued use of the Service after changes constitutes acceptance of the new Terms.
